Terms of Use

Last updated: September 21, 2026

What changed on September 21, 2026

  • You can now start using Herdbrary without creating an account (section 3.1). An email address is needed to start a free trial, subscribe, or invite others to your household.
  • New section 3.5: if you don’t save an email, your data is tied to your browser and device. We can’t recover it if you clear your browser data or lose the device, and unsaved accounts are permanently deleted after 90 days of inactivity.
  • Free trials now require a saved account with an email address (section 4.2a).

Please read these Terms of Use (“Terms”) carefully before using the Herdbrary application (“Herdbrary,” “the App,” “we,” “us,” or “our”). These Terms constitute a legally binding agreement between you (“you” or “User”) and Herdbrary governing your access to and use of the App.

By creating an account, accessing, or using Herdbrary, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old to create a Herdbrary account and use the App. By using Herdbrary, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Description of Service

Herdbrary is a homestead and small-farm animal management application that allows users to track animal health records, breeding, milk and egg production, fencing and shelter planning, meat processing information, and related recordkeeping for goats, sheep, cattle, horses, swine, rabbits, poultry, and livestock guardian dogs. Herdbrary is a recordkeeping and educational tool. It does not provide veterinary, medical, legal, or financial advice, and it is not a substitute for consultation with a licensed veterinarian, physician, attorney, or other qualified professional.

3. Accounts and Households

3.1. You can start using Herdbrary without creating an account. An email address is required to start a free trial, to subscribe to a paid plan, and to invite others to your household. If you create or save an account, you must provide accurate, current information.

3.2. Herdbrary organizes data by “household.” A household may have multiple members who can access and edit shared household data (animal records, paddocks, shelters, financial and processing records, etc.) via an invite system. By inviting another person to your household, or accepting an invitation to join one, you acknowledge that household data is visible to and editable by all household members.

3.3. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. For an unsaved account, you are also responsible for access to the device and browser that holds your data. Notify us promptly of any unauthorized use.

3.4. You are solely responsible for the accuracy of data you or other household members enter into the App, including animal health records, medication and withdrawal periods, and breeding records. Herdbrary is not responsible for errors, omissions, or consequences resulting from inaccurate data entry.

3.5. Unsaved Accounts. If you use Herdbrary without saving an email address, your data is tied to the browser and device you are using. We cannot recover it if you clear your browser data, lose or replace your device, or sign out, because we have no way to verify who you are. Unsaved accounts, and all data in them, are permanently deleted after 90 days of inactivity. You can save your account at any time by adding an email address and password, and your existing data will be kept.

4. Subscriptions and Payment

4.1. Herdbrary offers certain features on a paid subscription basis. Subscription plans, pricing, and included features are described within the App or on our website at the time of purchase and may change from time to time.

4.2. Billing and Auto-Renewal. Paid subscriptions automatically renew at the end of each billing period (monthly or annually, as selected) at the then-current price, unless you cancel before the renewal date. You authorize us (or our third-party payment processor) to charge your chosen payment method for each renewal period.

4.2a. Free Trials. Herdbrary may offer a free trial period for certain subscription plans. Starting a free trial requires a saved account with an email address. Unlike many subscription services, a Herdbrary free trial does not automatically convert into a paid subscription, and no payment method is charged when the trial ends. To continue using paid features after your trial, you must return to the App and affirmatively start a paid subscription yourself. If you take no action, your trial simply ends — access to paid features stops (or your account reverts to any available free tier), and you will not be charged. If you instead choose to start a paid subscription before your trial period ends, your trial ends immediately and your paid subscription — and billing — begins right away; you will not receive credit or extra time for any unused trial days. Only one free trial is available per person or household.

4.3. Cancellation. You may cancel your subscription at any time through your account settings or, if purchased through a third-party app store (such as Apple’s App Store or Google Play), through that platform’s subscription management tools. Cancellation takes effect at the end of your current billing period; you will retain access to paid features through that period.

4.3a. Effect of Cancellation on Your Data. Canceling a paid subscription does not delete your account or your data. At the end of your billing period, your account reverts to Herdbrary’s free tier: your household’s existing records remain intact and accessible, but features limited to paid plans are no longer available until you resubscribe.

4.3b. Complete Account Deletion. If you want your account and all associated data (including animal records, household data, and photos) permanently erased rather than downgraded, you may request complete account deletion at any time by contacting us at contact@herdbrary.com, or, where available, directly within the App. Complete account deletion is permanent and irreversible and cannot be undone. See our Privacy Policy for more on how we handle data retention and deletion.

4.4. Refunds. Except where required by law, payments are non-refundable, including for partial subscription periods, unused features, or early cancellation. If your subscription was purchased through a third-party app store, that platform’s refund policies apply.

4.4a. Billing Disputes. If you believe you were charged in error, or have any concern about a charge to your account, please contact us first at contact@herdbrary.com so we can review and resolve the issue directly. We ask that you reach out to us before initiating a dispute or chargeback with your bank or card issuer, as this allows us to address most billing concerns more quickly than the formal dispute process.

4.4b. Effect on Account Access. If a charge is reversed, refunded, or successfully disputed (including through a chargeback), we may suspend or downgrade access to the paid features tied to that charge until the matter is resolved. A payment reversal does not itself delete your data — your household’s records remain intact, and full access resumes once the payment issue is resolved or a valid payment method is put in place. Repeated or fraudulent chargebacks may result in termination of your account under Section 9.

4.5. Price Changes. We may change subscription prices from time to time. We will provide reasonable advance notice of any price increase affecting your then-current subscription, and any such increase will take effect at your next renewal unless you cancel beforehand.

4.6. Payment Processing. Payments are processed by third-party payment processors. We do not store your full payment card details. Use of a third-party payment processor is subject to that processor’s own terms and privacy policy.

4.7. State-Specific Auto-Renewal Disclosures. If you are a resident of California, New York, Vermont, or another state with laws governing automatically renewing subscriptions, you may have additional rights, including the right to clear and conspicuous disclosure of auto-renewal terms before you subscribe and the right to cancel through a cost-effective, timely, and easy-to-use mechanism. Nothing in this Section 4 is intended to limit any such rights available to you under applicable state law, and to the extent required by such laws, we will provide any additional notices or obtain any additional consents necessary before renewing your subscription.

5. No Professional Advice; Assumption of Risk

Important — please read

5.1. Educational content only. Herdbrary provides general, educational information about animal husbandry, fencing, shelter planning, health monitoring, breeding, and meat processing. This content is generalized and may not account for your specific animals, breed, region, climate, applicable law, or circumstances. It is provided “as is,” without warranty of any kind, and may be incomplete, outdated, or, despite our efforts at accuracy, contain errors.

5.2. Not veterinary, medical, legal, or financial advice. Nothing in the App constitutes veterinary, medical, legal, or financial advice. This includes, without limitation, guidance related to medication dosing, deworming protocols, humane slaughter and processing methods, fencing safety, and the legal ability to sell meat, milk, eggs, or other products. You should consult a licensed veterinarian, physician, attorney, or other qualified professional before making decisions based on information in the App, and before undertaking any activity described in the App that carries risk to animal welfare, human safety, or legal compliance — including, without limitation, administering medication, performing humane slaughter or processing, or building or modifying fencing or enclosures.

5.3. Assumption of risk. Activities described in the App — including animal handling, medication administration, humane slaughter and meat processing, and fencing and structure construction — carry inherent risks of injury, illness, death, or property damage. You voluntarily assume all such risks. You are solely responsible for complying with all applicable federal, state, and local laws and regulations, including those governing animal slaughter, meat processing and sale, medication use, and land use.

6. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of these Terms;
  • Attempt to gain unauthorized access to any part of the App, other users’ accounts or households, or our systems;
  • Reverse engineer, decompile, or attempt to extract the source code of the App, except as permitted by law;
  • Interfere with or disrupt the App’s operation or servers;
  • Use automated means (bots, scrapers, etc.) to access the App without our prior written consent;
  • Upload or transmit any content that is unlawful, infringing, or harmful to others.

7. User Content

7.1. “User Content” means any data, records, photos, or other content you or your household members submit to the App.

7.2. You retain ownership of your User Content. You grant Herdbrary a limited, non-exclusive license to store, process, and display your User Content solely for the purpose of operating and providing the App to you and your household members.

7.3. We may access aggregated, de-identified data derived from User Content for purposes of improving the App, provided such data does not identify you or any individual.

7.4. You are responsible for ensuring you have the right to submit any User Content (including photos) you upload.

8. Intellectual Property

The App, including its software, design, text, graphics, and other content (excluding User Content), is owned by Herdbrary or its licensors and is protected by intellectual property laws. Except for the limited rights expressly granted to you to use the App, no other rights are granted.

9. Termination

9.1. You may stop using the App and delete your account at any time.

9.2. We may suspend or terminate your access to the App, with or without notice, if we reasonably believe you have violated these Terms, engaged in unlawful conduct, or for any other reason at our discretion, including discontinuation of the App.

9.3. Upon termination, your right to use the App ceases. Provisions of these Terms that by their nature should survive termination (including Sections 5, 8, 10, and 11) will survive.

10. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT OR INFORMATION PROVIDED THROUGH THE APP.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HERDBRARY AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, ANIMALS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Herdbrary and its owners, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the App, your violation of these Terms, or your violation of any law or third-party right, including any claim arising from animal handling, slaughter or processing, or fencing or structure construction undertaken based on information in the App.

13. Changes to These Terms

We may update these Terms from time to time. We will provide notice of material changes (such as through the App or by email). Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles, unless otherwise required by applicable law. Any dispute arising from these Terms or your use of the App shall be resolved in the state or federal courts located in Texas, and you consent to the personal jurisdiction of such courts.

15. Miscellaneous

15.1. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

15.2. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.

15.3. These Terms constitute the entire agreement between you and Herdbrary regarding the App and supersede any prior agreements.
